1. Agreement

By using fixpayment.org or our software and related services, you agree to these Terms. If you do not agree, do not use the site or services.

2. What FixPayment is

FixPayment provides accounts receivable software and platform tools for creditors (portals, workflows, payment links, plans, settlements, risk scoring, APIs, and audit logs). We are not a law firm and do not provide legal, tax, or investment advice.

FixPayment provides accounts receivable software and related tools for creditors. Creditors remain responsible for their own collection practices and legal compliance.

Unless you and FixPayment execute a separate written agreement for platform-assisted operations, creditors (and their own staff or agents) remain responsible for contacting customers and for complying with applicable law.

3. Creditor Software Terms (MSA summary)

If you are a creditor or business customer:

  • Software license: We grant a limited, non-exclusive right to use the platform for your internal AR operations.
  • B2B scope: The platform is intended for commercial / business receivables. You must not use it to place consumer debts for personal, family, or household purposes unless we agree in writing and you hold any required licenses.
  • Your responsibility: You are responsible for the accuracy of account data, lawful outreach, consent for SMS/calls, licensing where required, and customer-facing branding.
  • Payments: Customer payments should settle to you (or your payment processor / merchant account). Platform fees (subscription, usage, optional success-based fees) are billed to you separately, not withheld from customer wallets as a money-transmitter model unless expressly agreed.
  • Audit trail: Status changes, disputes, and communications logged in the platform are available for your compliance review.
  • Indemnity: You agree to defend and indemnify FixPayment against claims arising from your use of the software, your outreach, or debts you place, except to the extent caused by our willful misconduct.

4. Account information

You agree to provide accurate information. Unauthorized use of another person's identity or account is prohibited.

5. Payments, plans & settlements

Payment plans, settlements, and offers are subject to creditor approval and documented terms. Until confirmed in writing, proposals are not binding commitments. Pricing may include platform subscription / usage fees and, where selected, success-based or hourly options described in your creditor portal.

6. Communications

Where the platform or a creditor contacts you about an account, contact may occur by phone, email, SMS, or mail as permitted by law and any consent you provided. You may submit a cease communication request in writing where applicable. Disputed accounts are paused from automated outreach pending review.

7. Website use

You may not misuse the site, attempt unauthorized access, or interfere with operations. Content is protected by applicable intellectual property laws.

8. Disclaimers & limitation of liability

Services are provided "as is" to the fullest extent permitted by law. We do not warrant that use of the software makes any party “compliant” with any particular statute. Our liability is limited to the maximum extent permitted by applicable law.

9. Governing law

These Terms are governed by the laws applicable where FixPayment principally operates, without regard to conflict-of-law rules, except where mandatory consumer or commercial protections require otherwise.
